The Sunset Lakes design review process is a strategic initiative designed to protect property values and long-term community quality by ensuring architectural excellence. By coordinating diverse home styles and promoting thoughtful property planning, the process aims to create a cohesive, attractive neighborhood that surpasses the aesthetic of typical production homes. Ultimately, these standards foster a harmonious environment that maximizes homeowner enjoyment and secures the significant investment made by every resident in the community.

 Process
 

Step 1 Review existing homes to get an idea of previously accepted designs;

 

Step 2 Submit a concept sketch and discuss your ideas with a member of the Design Review Committee to make sure you are heading in the right direction;

 

Step 3 Submit a formal Design Review Application. Prepare building plans, elevations (of all 4 sides) and site plan (depicting house, driveway, lamps, set back distances, tile bed, square footage, etc.) and submit. At this point amendments may be suggested.

 

Step 4 Receive written Design Review Approval.

The following are matters that should be considered prior to beginning construction:

 

     Roadside Ditches: The grades in the ditches are set according to the approved engineering design and have been installed and inspected         according to design. The ditches require a specified slope on the surface to carry off rainwater and run-off. In addition, driveway culverts               must be installed according to the drainage and grading design. The grades in the ditches must remain untouched so that the water drains       properly and the subdrains function properly. No additional sod, fill or topsoil should be placed in the ditches, and no vehicle should drive           over it;

 

     Zoning: This approval does not include or warrant compliance with any municipal zoning by-law, building code, or legal requirement. The         onus for such compliance remains with the owner.

 

     Grading & Drainage: A grading and drainage plan, which has been approved by the Municipality and registered on title to each lot in the           subdivision, applies to your lands. Each unit owner, prior to receiving final approval for his home, is required to comply with this plan;

 

     Lamp Posts: All lots must have two (2) photocell operated lawn lamps and two (2) pedestals on both sides of the driveway and set back 1.5         metres from road allowance.

 

     Changes & Future Improvements: All future improvements, sheds, pools fences, hedges, retaining walls, etc. require design review                     approval.

 

Please note that the applicants are responsible to ascertain City-approved under side of footing level and to comply with same.

1. Municipal Addresses – Addresses are usually issued following draft approval and prior to M Plan registration.

2. Legal Description and PIN Number – These are available shortly after the registration of the plan.

3. Inhibiting Order – The municipality places an Inhibiting Order on each lot until the R Plans, all easements and covenants are registered. The order will be lifted prior to registration of transfer to purchaser. A Solicitor’s Undertaking may be given to complete same. 

4. Closings – Please note that the completion of works for which provision is made in the subdivision agreement (asphalt, drainage) are completed following registration. Full security has been posted for these works and there is not a contractual provision between the Vendor and Purchaser permitting a delay or deferral of closing pending completion of specified works. At closing, owners association fees, a portion of realty taxes and the security deposit specified in the Agreement of Purchase and Sale will be collected. 

5. Design Review – Submission of home designs for Design Review approval should be forwarded to Sunset Lakes Developments as soon as they have been completed. The following is a link to design review information. Please note that design review approval does not include or warrant compliance with any municipal zoning by-law, building code or legal requirement. The onus for such compliance remains with the owner.  

6. Septic System Applications – Applications for a septic permit are to be submitted to the Rideau Valley Conservation Authority. Permits are issued within 10 business days. http://www.rvca.ca/ 

7. Building Permit Applications – Applications for a building permit are submitted to the City of Ottawa. 8. Lot Clearing – No clearing or construction on the lot will be permitted prior to closing. 

9. Lot Grading and Drainage Plans – The engineering drawings are approved prior to registration and usually attached to Agreements of Purchase and Sale.

Property Owners — South Village, Woodstream, Greely Orchard, Water’s Edge, Cedar Lakes, and Lakewood Trails

 

Upon the closing of your new property, you may have noticed that a security deposit of $2,000.00 (or more in newer developments) was collected as per Paragraph 15 of Schedule “C” of the Agreement of Purchase and Sale (Paragraph 57, Water’s Edge; Paragraph 58, Cedar Lakes; and Paragraph 52, Lakewood Trails). This deposit is collected and held until the completion of the installation of the culvert and all grading and other legal and contractual requirements are met.

Once the works are completed please refer to the following:

 

  1. Homeowners are asked to contact Sunset Lakes Developments (SLD) to request inspection of the property;
  2. Requests can be made by downloading a copy of the Application for Return of Security Deposit form found on our website.
  3. Please complete and sign the form and return to SLD.
  4. Once your application has been received, the inspections will be arranged.
  5. A City Inspector will determine whether or not requirements have been completed to the satisfaction of the City. Property owners may also be required to purchase and submit a Private Approach Permit to the City of Ottawa.
  6. Please note that for owners in Water’s Edge, Cedar Lakes and Lakewood Trails stamped as-built drawings from a surveyor or engineer must be submitted as per the requirements of the subdivision agreement.
  7. Upon notification of release and by the receipt of a complete and signed application, SLD will process the return of security. Note that the cost of rectifying any defaults may be deducted from the security deposit.

Assignment of Security Deposit

From time to time, home-buyers who were not the original purchasers of the lot from the developer, request the return of the $2,000.00 (or more in newer developments) security deposit collected on closing.  Please note that the contractual obligation to repay is with the entity who first purchased the lot.  That person is the party with which the developer has a contract and a binding legal obligation to repay the deposit money.  If the lot is subsequently conveyed, in order for the refund to go to the new owner, there must be a written assignment, release or direction from the original owner directing the vendor to refund the deposit to the named subsequent purchaser or his/her assignee.  Please note that we require written evidence of this assignment and the transfer of title is not sufficient without a direct written assignment of the deposit refund.
